DENVER, Co — Today, Representative Junie Joseph announced the upcoming introduction of a groundbreaking bill that will establish clear regulations for the use of artificial intelligence (AI) in health care and mental health services in Colorado. This legislation ensures that AI systems are used safely, ethically, and transparently, while maintaining the central role of licensed clinicians in all decisions that affect patients’ health and well-being.
The bill specifically:
Regulates the use of AI and algorithms in utilization review by insurance carriers, pharmacy benefit managers, and behavioral health organizations to ensure decisions are based on individual clinical information and free from bias or discrimination.
Prohibits the use of AI systems for providing psychotherapy directly to patients, ensuring that all therapy services remain under the supervision of qualified, licensed professionals.
Requires full disclosure to clients whenever AI is used in a therapeutic setting, including the name of the system, its purposes, and protections for client privacy and mental health data.
Establishes strict oversight for AI “mental health companion chatbots,” requiring clear notifications to users, proper crisis intervention protocols, and prohibition on the sale or misuse of identifiable mental health information.
“Every Coloradan deserves access to care that respects their dignity and individuality,” said Joseph. “As AI becomes more integrated into health care, we must ensure it supports—not replaces—the human connection essential to effective therapy. This bill protects patients, promotes equity, and preserves the role of licensed professionals in health decisions.”
The legislation is set to take effect on January 1, 2027, and applies to actions taken on or after that date. This measure positions Colorado as a national leader in responsible AI oversight in health care, setting clear standards that prioritize patient safety, equity, and ethical care.
